Thermia Device Product Data Information (Data Act)

This document describes product data generated by Thermia Devices in accordance with the information requirements of the Data Act.

  1. Definitions 

  1. Thermia means Thermia Aktiebolag, a company incorporated under the laws of Sweden with its principal place of business at Box 950, 671 29 Arvika, Sweden and company registration number 556269-6483. 

  1. Data Act means Regulation (EU) 2023/2854.   

  1. Thermia Device means Thermia-branded heat pumps and control cabinets. 

  1. Product Data means any data generated by a Thermia Device that constitute product data within the meaning of the Data Act. 

  1. User means a user of a Thermia Device. 

  1. Terms defined in the Data Act and used in this document, such as “product data” and “user”, shall have the same meaning as in the Data Act.  

  1. General 

  1. Thermia Devices are capable of generating Product Data. Depending on the model, configuration and settings of the device and User’s use of any related services, the properties of Product Data may vary, such as its type, format, volume and generation frequency. 

  1. Data types 

  1. Thermia Devices are capable of generating the following types of Product Data: 

  1. Data related to user settings, 

  1. Data collected by sensors, and 

  1. Data related to errors and alerts.

    Product Data types and their properties may vary depending on the model, configuration and settings of a Thermia Device and User’s use of any related services. 

  1. Data format 

  1. Thermia Devices are capable of generating Product data in a standardized machine-readable format. The format of Product Data may vary depending on the model, configuration and settings of the device, and User’s use of any related services. 

  1. Estimated volume 

  1. The estimated volume of Product Data generated by a Thermia Device may vary depending on its model, configuration and settings, User’s use of the device, and User’s use of related services. The following estimates are based on average usage of a Thermia Device in standard configuration:

  1. Data Generation Frequency 

  1. Thermia Devices are capable of generating certain types of Product Data continuously or in real-time. These capabilities may vary depending on the model, configuration and settings of the device, User’s use of the device, and User’s use of related services. 

  1. Data storage capabilities 

  1. Thermia Devices are capable of storing Product Data on-device or on a remote server. The storage location of Product Data may depend on the model, configuration and settings of the device, User’s use of the device, and User’s use of related services. In standard configuration, Thermia Devices store Product Data on-device. When connectivity is available, certain Product Data is also stored on a remote server. 

  1. Data retention periods 

  1. Product Data retention periods may vary depending on the model, configuration and settings of the Thermia Device, User’s use of the device, and User’s use of related services. The following intended retention periods are based on a Thermia Device in standard configuration.

  1. Data Access and retrieval 

  1. User may access and retrieve Product Data via the Thermia Data Act Portal, available at https://thermia.com/legal 

  1. Terms of use 

  1. Access, retrieval and use of Product Data is subject to the terms and conditions set forth in the Thermia EU Data Act Portal, available at https://thermia.com/legal. 

  1. Quality of service 

  1. Thermia makes reasonable efforts to reduce inaccuracies in Product Data and to provide access to Product Data in a timely manner. However, to the extent permitted by law, Thermia provides Product Data “as is” and “as available”, without any warranty of any kind. This means, among other things, that Thermia does not warrant that Product Data is accurate or will be available continuously or uninterruptedly. User’s or any third party’s use of Product Data is at their own sole risk.
