Information about data in Thermia Online PRO (Data Act)

This document provides information about the data obtained and generated by the Thermia Online PRO service (which is part of Thermia Professional Services) in accordance with information requirements of the Data Act.

 

  1. Definitions 

  1. Thermia means Thermia Aktiebolag, a company incorporated under the laws of Sweden with its principal place of business at Box 950, 671 29 Arvika, Sweden and company registration number 556269-6483. 

  1. Data act means Regulation (EU) 2023/2854. 

  1. Thermia Online PRO means the service of the same name provided by Thermia. 

  1. Thermia Devices means Thermia-branded heat pumps and control cabinets. 

  1. User means a Thermia Online PRO user. 

  1. Product Data means any data generated by Thermia Devices that constitute product data within the meaning of the Data Act. 

  1. Service Data means any data generated by Thermia Online PRO that constitutes related service data within the meaning of the Data Act. 

  1. Readily Available Data means any data generated by Thermia Devices or Thermia Online PRO that constitutes readily available data within the meaning of the Data Act. 

  1. Terms defined in the Data Act and used in this document, such as “product data”, “related service data”, “readily available data” and “user”, shall have the same meaning as in the Data Act.  

  1. Trade Secrets 

  1. Product Data, Service Data and Readily Available Data contain trade secrets owned by Thermia. Unauthorized use or disclosure of such data may cause considerable harm to Thermia. 

  1. Product Data 

  1. Thermia Online PRO obtains Product Data from User’s Thermia Device. The properties of Product Data may vary depending on the device's model, configuration, and settings, as well as how User uses Thermia Online PRO or other related services. These factors may, for example, affect the type, volume, retention period and collection frequency of Product Data. 

  1. The table below shows the types of Product Data that Thermia Online PRO may obtain, the estimated volume and the retention period. The information provided is based on a heat pump in standard configuration.

  1. Product Data is collected continuously, in real-time, at regular intervals, or as a result of specific events or User actions. The collection frequency may vary depending on the device model, configuration, and settings, as well as how User uses Thermia Online PRO or other related services. 

  1. Product Data may be stored locally on the User’s Thermia Device or on a remote server. The storage location depends, among other factors, on the model of User’s Thermia Device, its configuration and settings, User’s use of the device, as well as User’s configuration and use of Thermia Online PRO and other related services. 

  1. Service Data 

  1. Service Data is generated in connection with User’s use of Thermia Online PRO. The properties of such data may vary depending, among other factors, on the model of User’s Thermia Device, its configuration and settings, User’s use of the device, as well as User’s configuration and use of Thermia Online PRO and other related services. These factors may, for example, affect the type and volume of Service Data. 

  1. The table below shows the types and estimated volume of Service Data generated by Thermia Online PRO. The information is based on normal use of Thermia Online PRO with a heat pump in standard configuration.

  1. Service Data is primarily stored on remote servers. Depending on factors including User’s configuration of Thermia Online PRO, some Service Data may also be stored on the digital device used to access Thermia Online PRO. 

  1. Readily Available Data 

  1. Thermia and its affiliates may use Readily Available Data for the following purposes: 

  1. Fulfilling any agreement between Thermia and User 

  1. Providing remote diagnostics; 

  1.  Ensuring product safety; 

  1. Providing, maintaining and improving functionality; 

  1.  Preventive maintenance and quality assurance; 

  1.  Providing updates and customer support; 

  1. Providing services; 

  1.  Ensuring and maintaining information security; 

  1. Conducting research and product development; 

  1. Conducting analyses and compiling statistics; 

  1. Fulfilling administrative purposes; 

  1. Combining or aggregating such data with other data or creating derived data; 

  1. Monitoring User’s compliance agreements or any other applicable terms;  

  1. Handling legal claims; 

  1. Complying with legal obligations; and 

  1. Any other legitimate business purposes. 

  1. Thermia and its affiliates may share Readily Available Data with third parties to the extent necessary for the purposes set forth in clause 5.1 above, provided that such sharing is compliant with applicable law. 

  1. To the extent permitted by applicable law, Thermia and its affiliates may share anonymized statistics, aggregated data, or compilations of readily available data, or anonymized data derived from such data with third parties. 

  1. Thermia and its affiliates may not use Readily Available Data to derive insights about the economic situation, assets and production methods of, or the use by, User in any other manner that could undermine the commercial position of User on the markets in which User is active. 

  1. Accessing and sharing data 

  1. To access Readily Available Data and to subsequently use or share such data with eligible third parties, or to end such sharing, User must submit an access request using Thermia’s Data Act portal, available at https://thermia.com/legal/. Any such access, use, or sharing of Readily Available Data is subject to additional terms available in Thermia’s Data Act Portal. 

  1. Duration of the agreement 

  1. The agreement governing the use of Thermia Online PRO is effective until terminated. User may terminate the agreement at any time by terminating their Thermia Online PRO Account. 

  1. Use of Thermia Online PRO is governed by the service agreement for Thermia Professional Services, which remains in effect until further notice. User may terminate the service agreement by providing Thermia with thirty (30) days' written notice. Other terms regarding termination are set forth in the service Agreement. 

  1. Compliance and Complaints 

  1. Thermia is committed to processing data in a responsible, secure, and transparent manner. Thermia works continuously and systematically to ensure that data processing complies with the provisions of the Data Act. Should User nevertheless have any concerns regarding Thermia’s compliance with the Data Act, User may contact Thermia via Thermia’s Data Regulation Portal, available at https://thermia.com/legal/. Should User believe that Thermia is not complying with the Data Act’s rules regarding data sharing, User has the right to lodge a complaint with the competent supervisory authority (Post-och Telestyrelsen). 

  1. Identity of the Data Holder 

  1. Thermia is the data holder. Thermia may process Product Data, Service Data or Readily Available Data together with other parties, primarily affiliated companies such as companies within the same corporate group as Thermia. Thermia may also engage third parties to process such data on its behalf, including data processing service providers and other IT service providers. Such parties are generally established within the EU. Where applicable, Thermia ensures that such data is protected by appropriate security measures. Thermia may be contacted in matters relating to the Data Act via Thermia's Data Act portal, available at https://thermia.com/legal/.
